Terms of Use

The Site and all of its content including, but not limited to, all text and images ("Content") are owned and copyrighted by Hashmeta or others with all rights reserved unless otherwise noted. Any Content that is a trademark, logo, or service mark is also a registered and unregistered trademark of Hashmeta or others. Your use of any Content, except as provided in these Terms of Use, without the written permission of the Content owner is strictly prohibited.

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Site.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Site or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You hereby authorize us to charge your credit card or PayPal account on a recurring basis as set forth in your account for all charges to your account with Hashmeta including, but not limited to, subscription fees and all applicable taxes, at the rates in effect when the charges were incurred.

All payments made are non-refundable except where required by Singapore law. In the event of a price reduction or promotional offering, no refunds or credits will be applied to your account for prior subscriptions. The subscription fee will be billed at the beginning of your subscription and on each monthly renewal date thereafter unless and until you cancel your subscription.

We reserve the right to deactivate your access to the Site for failure to pay applicable fees. Upgrades or downgrades in subscription level will be subject to the terms posted at the time of upgrade or downgrade.

You are solely responsible for applicable taxes associated with the services. Hashmeta shall have no liability to you or any third party in the event that Hashmeta exercises any of its rights to terminate your account or restrict your access to the services and the Content. Upon termination, all data associated with your account may be deleted.

Hashmeta reserves the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, any service provided by the Site (or any part thereof) with or without notice.

You may not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site.

Hashmeta reserves the right to bar any such activity.

You shall be solely responsible for your own Content and the consequences of submitting and publishing your Content on the Site. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish Content you submit; and you license to Hashmeta all patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on the Site pursuant to these Terms of Use.

Unless otherwise noted, all Content, including without limitation all HTML and other code on the Site, is proprietary to Hashmeta or to other parties. All names, logos, and icons identifying Hashmeta's products and services are proprietary trademarks of Hashmeta (or its parents, subsidiaries, or affiliates), and all rights to such marks are reserved.

You may not use, copy, transmit, modify, distribute, or create any derivative works from the Content without prior written consent from Hashmeta. You may not use data mining, robots, or similar data gathering and extraction tools on any portion of the Site, or frame any portion of the Site or Content.

While Hashmeta uses reasonable efforts to ensure that the Content is timely and accurate, Hashmeta makes no representations or warranties for the accuracy of the Content on the Site. Hashmeta assumes no liability or responsibility for errors or omissions in the Content.

Hashmeta and its contributors may provide links to other Internet sites. Hashmeta makes no representations whatsoever about any other website that you may access through this one. When you access a non-Hashmeta website, you acknowledge that it is independent from Hashmeta and that Hashmeta has no control over the content on that website. In addition, a link to a non-Hashmeta website does not mean that Hashmeta endorses or accepts any responsibility for the content, or the use, of such website.

In connection with the use of our services, you shall not:

Hashmeta reserves the right to remove Content without prior notice. Hashmeta may also ban users who continually infringe the Terms of Use. Hashmeta cannot review all material posted to the Site. Hashmeta does not endorse, validate, or otherwise take responsibility for the contents of any statement placed on the Site by any user.

You acknowledge that by providing you with the ability to view and distribute Content through our Site, Hashmeta is not undertaking any obligation or liability relating to the Content.

Hashmeta and its designees shall have the right (but not the obligation) in their sole discretion to refuse, delete, or move any Content that is available via the services.

Without limiting the foregoing, Hashmeta and its designees shall have the right to remove any Content that violates the Terms of Use or is otherwise objectionable.

You further hereby grant to Hashmeta a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform any Content in connection with the services and Hashmeta's business, including without limitation for promoting and redistributing part or all of the Site (and derivative works thereof) in any media formats and through any media channels.

You further agree to defend, indemnify and hold harmless Hashmeta, its affiliates, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your Content caused damage to a third party.

Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary. Hashmeta, its affiliates, or designees may use anything you transmit or post for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast, and posting.

Furthermore, Hashmeta is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever, including but not limited to developing, manufacturing, and marketing products using such information.

There may be additional Terms of Use that apply to specific portions of the Site, to any content or to any services. You agree to abide by such other Terms of Use, and understand that they shall supplement these Terms of Use.

Please review these Terms of Use periodically for changes. If you object to any such changes, your sole recourse shall be to cease using the Site. Continued use following posting of any such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.

You agree that you will not upload, post, email, or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment in connection with the use of the Site.

You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the Content contained herein or for any other unauthorized purpose without our prior expressed written permission. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure.

You acknowledge that Hashmeta may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms of Use; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Hashmeta, its users and the public.

Hashmeta reserves the right, in its sole discretion, to terminate your access to all or part of this Site with or without notice.

Sections 2-4, 6-9, 11, and 19-23 shall survive any termination of these Terms of Use.

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to conflict of laws provisions. The parties hereby agree to the exclusive jurisdiction of the courts in Singapore.

Software from this Site is further subject to Singaporean export controls. Software from this Site may not be downloaded or otherwise exported or re-exported (i) into (or to a national or resident of) Cuba, Iraq, Libya, North Korea, Iran, Syria, or any other country to which the U.S. has embargoed goods; or (ii) to anyone on the Singapore Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Deny Orders.

By downloading or using the Software, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.

The Content included in the Site has been compiled from a variety of sources and are subject to change without notice as are any products, programs, offerings, or technical information described in this Site.

Use, duplication, or disclosure by or for the United States Government is subject to the restrictions set forth in DFARS 252.227-7013 (c)(1)(ii) and FAR 52.227-19.

These Terms of Use and Hashmeta's Privacy Policy, which is hereby incorporated by reference as if set forth fully herein, represent the entire agreement between you and Hashmeta with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Hashmeta with respect to the Site.

If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

A printed version of these Terms of Use and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

It is the express wish of the parties that these Terms of Use and all related documents have been drawn up in English.
